Consumer rights, cancellation, withdrawal and refund conditions
General Conditions
- If you place an order electronically through this website, you will be deemed to have accepted the preliminary information form and the distance sales agreement presented to you.
- Buyers are subject to the provisions of the Consumer Protection Law No. 6502, the Distance Contracts Regulation (Official Gazette: 27 November 2014, No. 29188) and other applicable legislation concerning the sale and delivery of purchased products.
- Shipping charges relating to the delivery of a product will be paid by the buyer unless otherwise stated during checkout.
- Each purchased product will be delivered to the person or organization at the address specified by the buyer, provided that delivery does not exceed the applicable legal period of 30 days. If the product is not delivered within this period, the buyer may terminate the agreement.
- The purchased product must be delivered completely, in accordance with the specifications stated in the order and together with any applicable documents, such as a warranty certificate or user manual.
- If fulfilling the order becomes impossible, the seller must notify the buyer in writing within three days of becoming aware of the situation. The total amount paid must be refunded to the buyer within 14 days.
If the Purchased Product Is Not Paid For
If the buyer does not pay the price of the purchased product or if the payment is cancelled or reversed in the bank records, the seller’s obligation to deliver the product will end.
Unauthorized Use of a Credit Card
If, after delivery, it is determined that the credit card used for payment was used unlawfully by an unauthorized person and the relevant bank or financial institution does not pay the product price to the seller, the buyer must return the product to the seller within three days. The applicable return shipping cost will be borne by the buyer, subject to mandatory consumer protection rules.
Unexpected Delivery Delays
If an unforeseeable force majeure event prevents the seller from delivering a product on time, the buyer will be informed.
The buyer may request:
- Cancellation of the order;
- Replacement with a similar product; or
- Postponement of delivery until the relevant obstacle has ended.
If the buyer cancels an order paid in cash, the amount paid will be refunded within 14 days of cancellation.
If payment was made by credit card, the product price will be returned to the relevant bank within 14 days of cancellation. Depending on the bank’s processing procedures, it may take an additional two to three weeks for the refund to appear in the buyer’s account.
Buyer’s Obligation to Inspect the Product
The buyer should inspect the goods or services before accepting delivery. Products with crushed, broken, torn or otherwise visibly damaged packaging should not be accepted from the delivery company.
Goods or services accepted at delivery will be considered undamaged and complete, except for defects that could not reasonably have been identified during delivery.
The buyer must take reasonable care of the goods or services after delivery.
If the right of withdrawal is exercised, the product must not be used beyond what is reasonably necessary to inspect it. The invoice and other required documents must be returned with the product.
Right of Withdrawal
The buyer may withdraw from the agreement within 14 days from the date the purchased product is delivered to the buyer or to the person or organization at the address specified by the buyer.
Subject to the applicable exclusions, the buyer may exercise this right without providing a reason and without incurring legal or criminal liability, provided that the seller is notified within the withdrawal period.
Withdrawal Period
For service purchases, the 14-day withdrawal period starts on the date the agreement is concluded.
The right of withdrawal may not be exercised for a service that begins before the withdrawal period expires where performance has started with the consumer’s prior approval and acknowledgment, subject to applicable law.
Expenses arising from the valid exercise of the right of withdrawal will be covered by the seller, subject to the conditions stated in the agreement and applicable legislation.
To exercise the right of withdrawal, the buyer must send written notice to the seller by registered mail or email within 14 days. The product must comply with the return conditions and must not fall within a category for which the right of withdrawal cannot be exercised.
Exercising the Right of Withdrawal
The invoice supplied with the product must be included in the return.
If the product was invoiced to a company or other legal entity, the return must also include the return invoice issued by that organization where required.
The return form, product box, original packaging and standard accessories must be returned completely and without unnecessary damage.
Refund Conditions
- The seller will refund the total amount and return documents that place the buyer under an obligation within the periods required by applicable legislation after receiving a valid withdrawal notice.
- If the value of the goods decreases or returning the goods becomes impossible because of the buyer’s actions or negligence, the buyer may be responsible for compensating the seller in proportion to the buyer’s fault.
- The buyer is not responsible for changes or deterioration resulting solely from inspecting or handling the product in a manner reasonably necessary to determine its nature, characteristics and operation during the withdrawal period.
- If exercising the right of withdrawal causes the order total to fall below the minimum amount required for a campaign or promotion, the relevant discount may be cancelled or recalculated.
Products Excluded from the Right of Withdrawal
Subject to applicable consumer protection legislation, the right of withdrawal may not apply to:
- Products prepared according to the buyer’s specifications or clearly personalized for the buyer;
- Products that may deteriorate rapidly or have a limited expiry date;
- Sealed products that are unsuitable for return for health or hygiene reasons if their seal or packaging has been opened after delivery;
- Underwear, swimwear, bikini bottoms, cosmetics and personal-care products where the relevant hygiene seal or packaging has been opened;
- Products that become inseparably mixed with other goods after delivery;
- Newspapers, magazines and other periodicals, except those supplied under a subscription agreement;
- Services performed immediately in an electronic environment and intangible goods delivered immediately to the consumer;
- Audio or video recordings, books, digital content, software, data-recording or storage devices and computer consumables if their protective packaging or seal has been opened;
- Reproducible software, DVDs, VCDs, CDs, cassettes and similar products where the packaging has been opened;
- Stationery consumables such as toner, cartridges and tape where opened, used or no longer suitable for resale; and
- Services that began before the withdrawal period expired with the consumer’s prior approval and acknowledgment, where permitted by applicable law.
Default and Legal Consequences
Where payment is made by credit card, the relationship between the cardholder and the issuing bank is governed by the applicable credit card agreement.
If the cardholder defaults on amounts owed to the bank, the bank may charge interest and pursue legal remedies in accordance with the relevant agreement and applicable law.
If the buyer defaults on an amount lawfully owed to the seller, the buyer may be responsible for losses caused by delayed performance to the extent permitted by applicable law.
Payment and Delivery
Purchases made through our website may be paid using the payment methods displayed during checkout. Where supported by the relevant card provider, single-payment or instalment options may be available. Online card payments are processed when the order is completed.
